The EIB, the European Union's bank, is seeking to recruit for its Legal Directorate (JU) – Legal Department Corporate (CORP) – Procurement, Technical Assistance and Administrative Law Division (PTA) at its headquarters in Luxembourg, a:

 

Associate) Lawyer specialised in contract law, litigation, real estate and construction

The term of the contract will be 4 years.

This is a full time position at grade 4/5

The EIB offers fixed-term contracts of up to a maximum of 6 years, according to its business needs, with a possibility to convert to a permanent contract, subject to organisational requirements and individual performance.

Panel interviews are anticipated for mid-January 2018.


 

Purpose

The successful candidate will assist the Head of Division, together with other legal advisers, in providing legal support to the administration and operational directorates for all issues the division may be required to deal with, but with the main emphasis on legal issues relating to construction, real estate, Luxembourg contract law and litigation.

Operating Network

The lawyer will act under the authority of the Head of Division and in accordance with the priorities established by her, in agreement with the Director.

Accountabilities

The lawyer will carry out work relating to all tasks within the remit of the Division and will manage dossiers relating to various operations with a particular emphasis on construction and real estate, and other Luxembourg law issues triggered by the Bank’s presence in Luxembourg. S/he will operate under the supervision of the Head of Division, whose instructions s/he will follow when dealing with complex dossiers and whose approval s/he will seek on fundamental or unusual matters. Without prejudice of carrying out legal work in relation with other issues the division may have to deal with, he/she will in particular be requested to:

  • Participate in the negotiation, drafting and / or review of legal documentation relating to all larger contracts with the Bank involving construction and real estate issues.

  • Participate in providing advice on specific legal issues relating to the Bank’s presence in Luxembourg.

  • Participate in providing advice on contractual rights and obligations and on how to manage risks associated to contracts subject to Luxembourg law, in particular in the fields of construction and real estate for the Bank’s own account.

  • Participate in providing advice on how to manage risks associated with dispute resolution and pre-litigation issues in the above mentioned fields.

  • Cooperate actively with other services within the Bank, taking a proactive, solution-oriented approach.

  • Advise on “Administrative” (in particular Luxembourg) law matters, for instance intellectual property issues.  

  • Participate in providing advice on dispute resolution before Luxembourg Courts.

  • Participate in, and advise on, the negotiation and drafting of agreements, notably in connection with the EIB Institute’s action. 

Qualifications

  • University degree in the law of one of the EU Member States, with a sound knowledge of civil law fundamentals. A further qualification and / or experience in Luxembourg law would be an advantage.

  • At least 3 years professional experience in the field of contract law with solid experience in litigation. Experience in any of the fields of Commercial law, Construction / Real Estate law, and/or Community law, especially in the Luxembourgish context, would be an advantage.

  • Experience in advising and drafting legal documentation in the abovementioned fields.

  • Experience in working with the European Institutions; substantial experience in working with an international law firm would be an advantage.

  • Familiarity with standard IT tools and Bank working procedures.

  • Fluent in written and spoken English and a good working knowledge of French (*). Knowledge of another language of the European Union would be an asset.

(*) There may be certain flexibility on this requirement, but limited to particularly suitable candidates who may not yet be proficient in French. If selected, such candidates will be hired on the condition that they build up rapidly knowledge of French and accept that their future career in the EIB may be subject to the attainment of sufficient proficiency in both of the Bank's working languages
