Depuis juin 2013, date des premières révélations d'Edward Snowden, la plupart des européens ont réellement pris conscience de ce qu'ils savaient déjà : toutes les technologies actuelles permettent de suivre nos vies et de nous profiler dans les moindres détails et ceci quelquefois dans l'illégalité. Cela ne se limite pas aux activités de surveillance mais concerne également les activités civiles et commerciales.

Op 25 november1 en 16 december 20152 zijn in het Europees Publicatieblad de  verordeningen verschenen waarbij met ingang van 1 januari 2016 de Europese drempelbedragen inzake de procedures voor het plaatsen van opdrachten worden aangepast. De nieuwe drempelbedragen gelden voor de periode 2016-2017.

Bank Tax as from Assessment Year 2016

As part of the tax shift from labour to capital, banks and insurance companies will have to contribute an additional EUR 100 million to the Belgian budget by way of a new tax. The so-called bank tax, which isn't so much an additional levy as it is a reduction in qualifying deductions from the tax base, was introduced by the Omnibus Act of 10 August 2015 (Belgian State Gazette, 18 August 2015) (hereinafter, the "Omnibus Act").

Adjustment with respect to the tax reduction for pension savings

A bill of law containing various provisions was recently submitted to Belgian Parliament. Amongst other measures this draft legislation contains a provision on the tax reduction for pension savings. In 2014 the European Court of Justice ruled that, as the Belgian tax reduction for pension savings is only possible for payments made to Belgian institutions and funds, Belgium did not fulfil its requirements with respect to the free movement of capital.

Réglementation sur la période d’attente de l’ancienne loi relative aux pratiques du marché illégale. Qu’en est-il sous la nouvelle loi ?

Le 29 octobre 2015, la Cour de cassation a tranché une question importante : la réglementation concernant la période d’attente (interdiction d’annoncer des réductions de prix durant la période d’attente), contenue dans l’ancienne loi relative aux pratiques du marché, est contraire à la Directive 2005/29/CE2 (‘Directive relative aux pratiques commerciales déloyales’). Ceci étant, l’arrêt ne se prononce pas sur la période d’attente sous la nouvelle réglementation reprise dans le Code de droit économique.
