As stated before, the Court of Cassation decided on 10 March 2008 that "except in the event of a breach of procedural formalities sanctioned by nullity, an illegally-obtained piece of evidence may only be dispelled if the irregularity of that finding undermines its credibility or adversely affects the parties’ right to a fair trial".
These principles have echoed through labour courts’ case law, as part of procedures relating to the dishonourable discharge of workers, based on evidence obtained through the control of the use of new technologies, conducted in violation of privacy protection rules.
