Le Tribunal de l’Union européenne (‘Tribunal’) vient de confirmer, dans son arrêt du 12 décembre 2019, que des feuilles de marijuana accompagnées des mots “Cannabis store Amsterdam” ne pouvaient être enregistrées en tant que marque en raison de l’atteinte potentielle à l’ordre public de l’UE. Bien que la légalisation de la consommation du cannabis pour usage personnel a tendance à se répandre, ces dernières années, dans différents Etats membres ainsi que la légalisation de la vente de certains produits contenant du cannabis à des fins thérapeutiques ou même récréatives, la jurisprudence européenne en matière d’enregistrement de marques demeure, quant à elle, plus conservatrice.
