On 18 May 2017, the Dutch-speaking Labour Tribunal of Brussels confirmed that an employer can deduct 4 weeks’ salary from the indemnity in lieu of notice that is due to a dismissed employee for outplacement services, even if this amount exceeds the maximum value of the outplacement assistance that the employee is entitled to.

The CJEU decides: it is lawful to exclude Turkish Agents from the Belgian Agency Act’s scope

In the context of a dispute between a Turkish agent and a Belgian principal, the Commercial Court of Ghent (Belgium) referred a request to the Court of Justice of the EU (CJEU) concerning the legal protection of a Turkish agent under Belgian/EU law. The agent and principal had expressly agreed that their agency agreement was subject to Belgian law.

Freezing’ bank accounts across Europe: the European Account Preservation Order (EAPO)

Creditors have now obtained a new – and important – tool for ‘freezing’ their debtor’s bank accounts throughout Europe with one single order. 

EU Regulation 655/2014 of 15 May 2014 establishing a European Account Preservation Order procedure to facilitate cross-border debt recovery in civil and commercial matters (‘EAPO Regulation’) came into force on 17 July 2014 and applies from 18 January 2017.
