The due date for the filing of the annual VAT sales listing is approaching!

VAT payers should file an annual return quoting their VAT taxable customers, i.e., the annual VAT sales listing. The filing deadline for this listing is rapidly approaching. Fines can be imposed for late filing. The filing is done electronically, through Intervat. 

What?

The annual sales listing contains the Belgian VAT numbers of all VAT liable clients to whom goods or services have been provided during the calendar year 2017 amounting to a value of more than EUR 250,00 (excl. VAT).

For each client which is included in the list, the total amount invoiced and the total amount of VAT charged (if any) have to be mentioned. If there were no sales which should be included in the annual sales listing during the calendar 2017, the taxable person should still file a nihil listing. However, no separate nihil listing should be filed in case the box for a nihil listing is ticked in the December 2017 VAT return (or the VAT return for the 4th quarter of 2017).

Who?

In principle every VAT liable taxable person has to file the listing. However, enterprises which only conduct activities that are exempted from VAT (according to article 44 of the Belgian VAT code) are exempted from filing the annual sales listing.

Enterprises which conduct exempted activities as well as VAT liable activities still have to file an annual sales listing but they can exclude the VAT exempted sales from this listing.

Finally, enterprises which are part of a VAT group should file the annual sales listing per separate member of the VAT group and should include qualifying transactions between the members of the VAT group.

When?

The annual sales listing for the calendar year 2017 has to be filed before 31 March 2018 at the latest. 

In case this listing is filed too late, a fine can be imposed. This fine can range between EUR 75 and EUR 1.500 if the listing is filed within 3 months after the due date, between 225 EUR and 2.250 EUR if the listing is filed within 3 to 9 months after the due date and finally, if the listing is filed after this period or not filed at all, a fine of 3.000 EUR can be imposed.

How?

The annual sales listing should be filed electronically via Intervat.
