On 25 July 2014, after approval by the Flemish, Brussels and Walloon governments, the contract for the kilometre charge for trucks was concluded between the interregional entity Viapass and Satellic NV (a project corporation founded by the Sky-ways consortium, i.e. T-Systems International and Strabag AG).
The kilometre charge for trucks above 3.5 tons will come into effect in 2016. Satellic NV will be responsible for collecting the contributions in this interregional project. With the implementation of the kilometre charge for trucks, the three regions have implemented the European toll directive.
As legal partner in the Fairway consortium, Eubelius advised the three regions, SOFICO and also Viapass on the structuring of this project, the adjudication order procedure and the contract negotiations. This is one of the largest successfully closed PPP projects in Belgium.
Besides Eubelius, KPMG (financial partner) and Collis (technical partner) were also part of the Fairway consortium.
